Introduction These Terms of Service (“Terms”) govern your relationship with New Path Webworks and your use of our web design, web management, and web hosting services. By engaging our services, you agree to abide by these Terms.
Services Provided New Path Webworks offers:
- Web Design
- Web Management
- Web Hosting
- Hourly Consultation
- Monthly Subscription Service for routine site maintenance (minor updates, content adjustments, and regular website upkeep, excluding major revisions and new content creation)
Client Responsibilities Clients must provide all necessary and relevant content, images, information, and documentation requested by New Path Webworks. Clients are solely responsible for ensuring they own or have explicit rights to use all content provided. Clients assume full liability for any legal issues arising from unauthorized use of content.
Payment Terms Services are billed hourly, payable within 15 days from the invoice date (Net 15 terms). There is no upfront deposit required. Failure to pay within the specified period may result in suspension or termination of services.
Monthly Subscription Our monthly subscription service covers regular, minor website updates and basic site maintenance tasks, such as updating existing content, images, dates, and minor layout adjustments. It does not include new content creation or extensive revisions.
Intellectual Property Rights New Path Webworks retains all rights and ownership of design elements created for client projects. Clients may negotiate to purchase design rights separately at an agreed-upon later date.
Termination of Services Either party may terminate services under the following conditions:
- Non-payment by the client beyond the 15-day payment period.
- Breach of these Terms by either party.
Notice of termination must be communicated clearly in writing via email or other agreed-upon communication methods.
Limitation of Liability New Path Webworks will not be held liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from the use or inability to use our services.
Clients agree to indemnify and hold harmless New Path Webworks from any claims, losses, damages, liabilities, costs, and expenses arising from content provided by clients or any breach of these Terms.
Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States. Any disputes arising under these Terms shall be subject to the jurisdiction of Maine courts.
Updates to Terms We reserve the right to update these Terms periodically. All updates will be posted clearly here, with an updated revision date.
